Homa Bay South MP Peter Kaluma could find himself in trouble allegedly for going against court orders to provide upkeep for the children of a woman he dumped.

Martha Akinyi Ojera moved to court in May 2014 seeking maintenance of a boy and a girl aged 11 and eight years from the lawyer politician.

That was six years after the court had first ordered the MP to cough up upkeep cash that now stands at Sh 3.7 million.

Kaluma had then claimed that he was unable to provide for the girl Akinyi was living with as he had been catering for the boy for around seven years. Further, he attached his payslip indicating he earned less than Sh51,000 after loan and mortgage deductions.

But the court directed that he pay Sh20,000 as monthly upkeep of the children and that “the defendant also to pay school fees for the children when they join school and even pay for the cost of the suit” the order read in part, and that the
“the plaintiff has responsibility and will cater for the other requirements”.

The plaintiff was also to have custody of the children.

Akinyi claims she met Kaluma in September 2001 when he was a practicing advocate and after some time they met his parents who had no objections. They lived together for four years in which time they sired one child before Kaluma dumped her in April 2007 when she was pregnant with their second child.
Akinyi now claims the legislator never complied with court orders despite directions that he stuck with them seven days after the orders were issued.

In sworn affidavit drawn and filed by Odinga Oboge Advocates and served to the MP, Akinyi claims Kaluma has never provided of their children since the court’s directions in 20008.
A warrant of arrest was issued on February 2015 but the lawmaker complied pointing out that he had never been served the papers leading to adjournment of the matter. In another warrant of arrest dated June 10, Kaluma was supposed to show up in person to explain  why he ought not to be arrested but he allegedly made similar applications.

According to the court document Akinyi claims the  balance since the first orders were issued in 2008 has piled to Sh3,705,000 as of May 31, 2016.

In his replying affidavit dated August 2, Kaluma has claimed that he has been taking care of his son as father after Akinyi left when he was only two and that the boy has been happy to live with him.

Kaluma claims that Akinyi has never been his wife although he has been paying  school fees and other expenses.

The ruling on the matter will be made on October 26.
